Terms of Use
These Terms of Use (“Terms”) govern your access to and use of First Plate (the “App”), a complementary-feeding information, planning, tracking, recipe, and AI-assistant application provided by XenDevApp (“we,” “us,” or “our”). By downloading, accessing, or using First Plate, you agree to these Terms.
Important medical and safety disclaimer
First Plate provides general educational information only. It is not medical advice, diagnosis, treatment, emergency guidance, or a substitute for a pediatrician, registered dietitian, or other qualified healthcare professional. Always consult the child’s pediatrician about readiness for complementary feeding, allergies, growth, prematurity, medical conditions, and individual needs.
1. Adult caregiver responsibility
First Plate is intended for adults who are legally permitted and appropriately placed to make or support caregiving decisions for a baby or child. The App is not directed to children and must not be used by a child without responsible adult involvement.
If you enter information about a child, you represent that you are the child’s parent, legal guardian, authorized caregiver, or otherwise have lawful permission to provide and use that information. You are responsible for supervising food preparation and feeding and for all decisions made using the App.
2. What First Plate provides
First Plate may provide age-oriented food and recipe discovery, meal ideas, pantry and shopping tools, saved items, tasting and reaction logs, taste-profile insights, reminders, app updates, and AI-generated responses from First Plate Chef. Features and content may differ by version, region, language, age stage, subscription status, service availability, and device.
First Plate may organize content using general complementary-feeding principles described in publications from the World Health Organization (“WHO”) and parent education made available by the American Academy of Pediatrics (“AAP”), including HealthyChildren.org. First Plate is not affiliated with, sponsored by, endorsed by, or certified by WHO or AAP. References to those organizations do not mean that they reviewed or approved any individual First Plate recipe, recommendation, AI response, or feature.
3. No medical or professional relationship
Use of First Plate does not create a doctor-patient, dietitian-client, healthcare-provider, fiduciary, or other professional relationship. First Plate and First Plate Chef do not know the child’s complete medical history, development, clinical findings, medication use, allergy history, growth pattern, swallowing ability, or family circumstances.
Do not delay or disregard professional medical advice because of information shown in First Plate. Content can become outdated as guidance changes. Where App content differs from instructions given by the child’s healthcare professional, follow the qualified professional who knows the child’s circumstances.
4. Emergency situations
First Plate is not an emergency service and is not designed to detect or respond to emergencies. If a child has trouble breathing, blue or grey coloring, facial or tongue swelling, collapse, unresponsiveness, suspected choking, or another potentially serious or life-threatening symptom, stop using the App and contact local emergency services immediately. Do not wait for First Plate Chef to respond.
5. Feeding, allergy, and food-safety risks
Complementary-feeding readiness and safe preparation depend on the individual child. Age labels are general orientation, not a determination that a food, texture, portion, ingredient, allergen, or recipe is safe or suitable for a particular child. You are responsible for checking and safely adapting all content before use.
You agree to consider, among other things:
- The child’s developmental readiness, medical history, allergies, intolerances, and clinician instructions;
- Choking hazards, food shape, texture, size, seating, supervision, and age-appropriate preparation;
- Ingredient labels, cross-contact, substitutions, freshness, hygiene, cooking, storage, and serving temperature;
- Applicable guidance concerning honey, unpasteurized foods, added salt or sugar, whole nuts, and other hazards;
- That recipes and ingredient data may contain errors, omissions, localization issues, or supplier changes.
Never leave a child unattended while eating. If the child has severe eczema, a known or suspected allergy, prematurity, poor growth, swallowing difficulty, persistent vomiting or diarrhea, blood in stool, or another medical concern, obtain individualized professional guidance before relying on general App content.
6. First Plate Chef and AI limitations
First Plate Chef uses artificial intelligence. AI output is probabilistic and may be inaccurate, incomplete, inconsistent, outdated, fabricated, mistranslated, or inappropriate for the child. The AI may misunderstand age, ingredients, symptoms, or your question. It cannot examine the child or verify that user-provided context is correct.
You must independently review every AI response and consult a qualified healthcare professional when health, allergy, feeding readiness, growth, medication, diagnosis, treatment, or safety may be involved. Do not use Chef to make emergency or high-risk decisions. Do not submit unlawful material, confidential credentials, complete medical records, payment data, or unnecessary personal information.
7. User-provided information and logs
You are responsible for the accuracy and lawfulness of information you enter, including birth date, age, pantry foods, taste reactions, notes, and Chef messages. Tracking a food as tried or liked does not establish clinical safety, rule out an allergy, or guarantee future tolerance. Taste-profile insights are product personalization, not a medical assessment.
8. Acceptable use
You must not:
- Use First Plate unlawfully, fraudulently, abusively, or to harm a child or another person;
- Attempt to bypass subscriptions, security, App Check, rate limits, or access controls;
- Reverse engineer, scrape, copy, automate, disrupt, overload, probe, or gain unauthorized access to the App or its services, except where law expressly permits;
- Use First Plate Chef to generate harmful, deceptive, illegal, or rights-infringing content;
- Misrepresent First Plate output as advice from XenDevApp, AAP, WHO, a doctor, or another professional;
- Use the App in a way that infringes privacy, intellectual-property, or other rights.
9. Premium features and subscriptions
First Plate may offer optional First Plate Premium subscriptions. Available plans, prices, currencies, trials, offers, renewal periods, and included features are displayed in the App and Google Play before purchase. Subscriptions may renew automatically unless canceled before the renewal date shown by Google Play.
Google Play processes payments and governs billing, cancellation, refunds, payment failures, grace periods, account hold, and related purchase matters under its terms. Uninstalling First Plate does not cancel a subscription. Manage or cancel through Google Play. Access normally continues until the end of the paid period after cancellation, unless Google Play’s applicable terms provide otherwise.
Trials and promotions may be limited by region, account eligibility, time, or store rules. Unless canceled as disclosed during purchase, a trial may convert to a paid subscription. We may change Premium features for future billing periods, subject to applicable law and required notice.
10. Intellectual property and license
First Plate, including its software, design, branding, text, graphics, organization, and original content, is owned by XenDevApp or its licensors and protected by applicable laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the App for lawful, non-commercial caregiving purposes on supported devices.
Third-party names and marks belong to their respective owners. No license or endorsement is implied by a reference to Google, Firebase, Gemini, Google Play, OneSignal, WHO, AAP, or HealthyChildren.org.
11. Third-party services
First Plate relies on third-party services, including Google Play, Firebase, Google Cloud, Gemini models, OneSignal, hosting, and network providers. Their services may be unavailable, changed, or governed by their own terms and policies. We are not responsible for third-party services to the extent permitted by law. Review our Privacy Policy for data practices.
12. Availability, updates, and changes
We may correct, update, add, remove, restrict, suspend, or discontinue content or features at any time. We do not guarantee uninterrupted operation, permanent availability of a recipe or AI model, compatibility with every device, or that errors will be corrected immediately. Force or recommended updates may be used when a version is outdated, unsafe, unsupported, or incompatible with services.
13. Disclaimer of warranties
To the maximum extent permitted by applicable law, First Plate and all content and services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. XenDevApp disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, quiet enjoyment, availability, and that the App will be error-free or meet every user’s requirements.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.
14. Assumption of responsibility
You understand that food preparation and feeding involve inherent risks, including choking, allergy, contamination, burns, intolerance, and other adverse outcomes. To the extent permitted by law, you remain responsible for reviewing ingredients and instructions, obtaining professional advice, supervising feeding, responding to symptoms, and deciding whether and how to use App content.
15. Limitation of liability
To the maximum extent permitted by law, XenDevApp and its owners, personnel, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, revenue, profits, goodwill, or opportunity; or damages arising from reliance on AI output, recipes, age labels, translations, reminders, taste insights, service interruptions, or third-party services.
Any limitation applies only to the extent lawful and does not exclude liability that cannot be excluded under mandatory consumer-protection or other applicable law.
16. Suspension and termination
You may stop using First Plate at any time. We may suspend or terminate access to all or part of the App if we reasonably believe these Terms were violated, use creates risk or harm, services are abused, law requires it, or continued operation is no longer practical. Provisions that by their nature should survive termination remain effective, including intellectual property, disclaimers, liability limits, and dispute provisions.
17. Changes to these Terms
We may update these Terms to reflect changes in First Plate, providers, law, or risk. The effective date will be revised. Material changes may be communicated through the App, Store listing, or another reasonable method. Continued use after updated Terms become effective constitutes acceptance where permitted by law. If you do not agree, stop using the App.
18. Governing law and consumer rights
Unless mandatory consumer law requires otherwise, these Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. Courts and authorities with jurisdiction are determined under applicable law. If you are a consumer, you retain the mandatory protections and dispute rights available in your country of residence.
19. General terms
If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale, subject to applicable law. These Terms and the Privacy Policy form the agreement concerning your use of First Plate.
